Submission to ALRC review of Equality, Capacity and Disability in Commonwealth Laws
OII Australia has just made a submission to the Australian Law Reform Commission in relation to its inquiry on Equality, Capacity and Disability in Commonwealth Laws:
This Inquiry will examine laws and legal frameworks within the Commonwealth jurisdiction that deny or diminish the equal recognition of people with disability as persons before the law and their ability to exercise legal capacity, and consider what, if any, changes could be made to Commonwealth laws and legal frameworks to address these matters.
The Issues Paper for the inquiry made reference to last year’s Senate report on Involuntary or coerced sterilisation of intersex people in Australia and, while those issues were not part of the Discussion Paper, we wished to respond to that Paper.
This is a relatively brief submission that revisits data from many of our submissions to recent Senate inquiries.
