This submission has been superseded by later policy, based on the 2013 Malta Declaration, a joint submission to the Attorney General's Department on the guidelines in 2015, and the 2017 Darlington Statement.

These call for the redefining of 'X' in the guidelines as meaning 'non-binary', removing a contradiction where the guidelines both recognise the diversity of identities and sex classifications held by intersex people and also name intersex within a definition of X.

This contradiction has caused significant problems.
